Application of terms

These Terms apply to your use of this Website.  By accessing and using the Website:

  • you agree to these Terms; and 

  • where your access and use is on behalf of another person (e.g. a company), you confirm that you are authorised to, and do in fact, agree to these Terms on that person’s behalf and that, by agreeing to these Terms on that person’s behalf, that person is bound by these Terms.

If you do not agree to these Terms, you are not authorised to access and use the Website, and you must immediately stop doing so.  

Privacy Policy

By using our website, you accept and agree to our privacy policy.

Your personal information will be used, according to our privacy policy, for the purpose of processing your order and providing you with our products and services. 

We operate on Squarespace. Squarespace therefore collects and securely stores personal information on our behalf. 

Purchasing

We accept payment by Visa, Mastercard, Apple Pay, Google Pay.   

An order made via this site is a request to purchase one or more products (“order”). Where we receive a valid order, we will accept this by confirming via email that your selected payment method has been debited and that we are preparing the Order for delivery to the shipping address you have nominated. Where we are unable to fulfil your order, you will be refunded, and we will notify you by email. Individual card issuers control the time frame for refunds and should be contacted for further details. 

Pricing

All prices are in New Zealand Dollar (NZ$) and include GST (15% sales tax). 

Shipping costs (if any) are not included in the sale price and are added at checkout. 

Prices are subject to change without notice. 

We reserve the right to amend any pricing errors displayed due to human error, computer malfunction or other reason. We will notify you of any error in pricing and you may elect not to purchase the goods where the price has been corrected. 

Discounts

Any discount codes will be applied at checkout and before payment. We will not reimburse you for any failure to use a discount after payment has been processed. Discount codes may only be used on full priced items and may not be used on bundle deals. 

Returns 

Items must be returned within 14 days of receipt, in their original packing, in new and unused condition. We may either refund you in full or exchange the item for another of the same value. Where there is a difference in value, we will refund you or ask you to cover the difference. You will be responsible for return shipping costs and in the case of an exchange any new shipping costs. 

We retain the right to refuse returns where our requirements have not been met. 

In the case of faulty items please contact us at hello@maebl.co.nz. If your return is accepted, we’ll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

Delivery

Any shipping fee will be added to the purchase price at checkout. 

We endeavour to ship orders as soon as possible, generally within 24 hours of the order. We acknowledge however that technical or other issues may cause a delay in delivery. You should receive your order within a reasonable time frame, we will keep you updated where there are any substantial delays. 

We do not guarantee 3rd party delivery times as these are not within the bounds of our control. We therefore will not be held liable for late deliveries, or any loss, damage or cost incurred due to late delivery. 

Products will be shipped to the shipping address as provided by you. We will not be liable for any orders that do not arrive due to inaccuracies in the shipping details you provide.   

Copyright

We (and our licensors) own all proprietary and intellectual property rights in the Website (including all information, data, text, graphics, artwork, photographs, logos, icons, sound recordings, videos and look and feel), and the Underlying Systems.

Disclaimer

To the extent permitted by law, we and our licensors have no liability or responsibility to you or any other person for any Loss in connection with:

  • the Website being unavailable (in whole or in part) or performing slowly;

  • any error in, or omission from, any information made available through this Website;

  • any exposure to viruses or other forms of interference which may damage your computer system or expose you to fraud when you access or use the Website.  To avoid doubt, you are responsible for ensuring the process by which you access and use the Website protects you from this; and

  • any site linked from the Website.  Any link on the Website to other sites does not imply any endorsement, approval or recommendation of, or responsibility for, those sites or their contents, operations, products or operators. 

We make no representation or warranty that the Website is appropriate or available for use in all countries or that the content satisfies the laws of all countries.  You are responsible for ensuring that your access to and use of the Website is not illegal or prohibited, and for your own compliance with applicable local laws. 

Liability 

To the maximum extent permitted by law:

  • you access and use the Website at your own risk; and 

  • we are not liable or responsible to you or any other person for any Loss under or in connection with these Terms, the Website, or your access and use of (or inability to access or use) the Website.  This exclusion applies regardless of whether our liability or responsibility arises in contract, tort (including negligence), equity, breach of statutory duty, or otherwise. 

Except to the extent permitted by law, nothing in these Terms has the effect of contracting out of the New Zealand Consumer Guarantees Act 1993 or any other consumer protection law that cannot be excluded.  To the extent our liability cannot be excluded but can be limited, our liability is limited to NZD100 or the value of the goods ordered, whichever is greater.

To the maximum extent permitted by law and only to the extent clauses above do not apply, our total liability to you under or in connection with these Terms, or in connection with the Website, or your access and use of (or inability to access or use) the Website, must not exceed NZD100 or the value of the goods ordered, whichever is greater.  

Prohibited uses

In addition to other restrictions as set out elsewhere in these Terms, you are prohibited from using the site or its content: 

  • for any unlawful purpose or to solicit others to perform or participate in any unlawful acts; 

  • to infringe upon or violate our intellectual property rights or the intellectual property rights of others; 

  • to harass, abuse, insult, harm, defame, or discriminate any person; 

  • to submit false or misleading information; 

  • to upload or transmit viruses or any other type of malicious code;

  • to collect or track the personal information of others; 

  • for any obscene or immoral purpose. 

Termination of Website

We may at any point without notice: 

  • change the format of this site; 

  • stop providing, suspend or restrict your access to this site where you fail to comply with any obligations either under these terms or otherwise; 

  • suspend or terminate the operation of this site (in whole or in part).
